Project overview
At both national and international levels, institutions and legal practitioners frequently invoke the concept of “human dignity” as a key normative standard in the formulation and application of laws, particularly within the judicial context. However, this widespread application of the concept often reveals significant shortcomings that can impact the quality of the decisions made. Given the normative importance of human dignity—considered by some as “the most fundamental concept of law” (Atienza, 2022)—it is essential to analyze and address these deficiencies. The increasing prominence of dignity in public discourse, fueled by its recognition in constitutional and international law, highlights the necessity for a thorough examination of this subject.
