Chile\u2019s decentralization process is analyzed in the light of comparative experience and an from a legal and political science approach, to understand this process as widely as possible. The weight of history and tradition is emphasized to understand current institutional designs, with a special mention to the two dictatorships and later transitions, that shape the institutional present in both countries. The work takes as a paradigmatic example the educational policy and its municipalization during Pinochets\u2019 dictatorship. This example demonstrates how the implementation of such an hybrid institutional design, between a decentralized and a centralized structure, generates serious dysfunctions designs. Thus, the debate is reviewed regarding the need to reorganize the Chilean state from two of the main proposals for new constitution that have arisen and the way they conceive the place of local governments and the decentralization process of the whole system.<\/p>\n<p><em>Este documento analiza la posici\u00f3n institucional de los gobiernos locales y regionales en Chile y su dise\u00f1o institucional, a partir de la comparaci\u00f3n con el caso espa\u00f1ol. Se analiza el proceso descentralizador chileno a la luz de la experiencia comparada y con una aproximaci\u00f3n fundamentalmente jur\u00eddica y politol\u00f3gica para comprender este proceso de la forma m\u00e1s amplia posible. Se enfatiza el peso de la historia y de la tradici\u00f3n para comprender los actuales dise\u00f1os institucionales, con una menci\u00f3n especial a las dos dictaduras y posteriores transiciones que marcan profundamente el presente institucional de ambos pa\u00edses. El trabajo toma como ejemplo paradigm\u00e1tico la pol\u00edtica educativa a partir del an\u00e1lisis de su municipalizaci\u00f3n durante la \u00e9poca de la dictadura pinochetista. Este ejemplo demuestra como la puesta en marcha de dise\u00f1os institucionales a medio camino entre un modelo descentralizado y una estructura centralizada generan una suerte de modelo h\u00edbrido que tiene disfunciones graves. As\u00ed, se repasa el debate en torno a la necesidad de reorganizar el Estado chileno a partir de dos de las principales propuestas de nueva constituci\u00f3n que se han planteado y como \u00e9stas conciben el encaje de los gobiernos locales y el proceso de descentralizaci\u00f3n del conjunto del sistema.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Medir, Ll.
