Students on unpaid curricular external academic placements
Below is a description of the steps to follow in the event that a student on an unpaid curricular external academic placement suffers an accident. The action to be taken will depend on whether immediate vital health care is required and on the student’s situation in relation to the placement.
Given that ALL students on work experience placements are subject to the provisions of the 52nd additional provision of the revised text of the General Social Security Act (TRLGSS) approved by RDL 8/2015 of 30 October, and must therefore be registered with the Social Security, the situations in which students may find themselves are basically as follows:
- Students registered with the UB’s Social Security system: In accordance with the provisions of the 52nd additional provision, and given that students must be registered with the General Social Security System, any accident that may occur during the work placement must be dealt with under this system.
- Persons who are registered in any of the Social Security regimes, working as employees or self-employed.
- Persons in a situation assimilated to registration with an obligation to pay contributions or when the period has the status of having paid contributions for the purposes of benefits.
- Persons who have the status of retirement or permanent disability pensioners of the Social Security, whether contributory or non-contributory.
- Persons receiving contributory unemployment benefit and contributory allowance, including unemployment benefit for the over 52s.
In the case of students included in one of the situations of incompatibility, the regime under which the possible accident will be treated will be different depending on the age of the student:
- People under 28 years of age are subject to compulsory school insurance.
- Students over 28 years of age are subject to an accident insurance policy, which is compulsory for curricular internships.
1. If the student requires immediate life-saving care
In case of a life-threatening emergency, call 112 immediately
These are cases where the accident involves a clinical condition of the injured person, involving an objective life-threatening risk, or serious functional sequelae to the patient’s health, if immediate medical attention is not provided. Once the injured person is stabilised and life-saving, the accident should be reported in accordance with points 2.1 or 2.2 of this protocol.
2. If the student does NOT require immediate life-saving health care
In the event that the student does not require immediate vital health care, the action to be taken will depend on the student’s situation, and will follow the regulations in the following sections.
Only in the case of students who are doing a traineeship in health care institutions and require the first care due to accidental puncture, cut or splash with sanitary material or biohazard, or biohazard situations, the action to be taken in the first instance shall be as regulated in point 3, and then continue with the following points 2.1 or 2.2, as the case may be.
2.1. Trainees who are registered by the UB with the Social Security in accordance with additional provision 52a of the TRLGSS
Any accident at work or occupational illness occurring during the work placement (including accidents in itinere) where direct causality between the practical activity and the injury can be demonstrated, will be managed by the collaborating Social Security entity, which in the case of the UB is Mutua Universal.
In this case, the casualty or any other person represented by the casualty should follow the following steps:
- Report the accident immediately to the clinical tutor and the associate lecturer.
- Call the UB Medical Service on 934 024 597 on weekdays from 8 a.m. to 6 p.m. or the Mutua Universal line 900 20 32 03 (24 h) and from abroad + 34 934 12 33 67. The Medical Service will confirm with the Social Security Registration Service that the accident occurred while the practical activity was being carried out.
- Complete the OSSMA accident and incident notification form. In order to receive assistance from the Mutua Universal, the UB Medical Service must issue a medical certificate stating that the accident occurred while the employee was carrying out the practical activity, i.e. at the place and during the stipulated hours, or on the way to or from the place of work (in itinere accident). If the accident occurs outside the Medical Service’s opening hours, the claim form will be processed retrospectively.
- Consult Mutua Universal’s network of centres via the website or the mobile app.
In the event that the student needs to follow up the accident, this will be carried out by Mutua Universal and the UB Medical Service. If the student has been transferred to a different centre in the Mutua Universal network of centres, the UB will inform them where they have been transferred so that the Mutua Universal medical team can monitor and coordinate the possible transfer to their own centre.
The Student Care Service will inform the CONTA Register of serious, very serious and fatal accidents, or if more than four workers are involved, within 24 hours and minor accidents and incidents within the legally stipulated timeframe.
2.2. Trainees who are NOT registered by the UB with Social Security due to incompatibility in accordance with Article 80 of Royal Decree 8/2023
In these cases, a distinction must be made between students under 28 years of age, who are subject to compulsory school insurance, and students over 28 years of age, who are subject to a compulsory accident policy.
2.2.1. Under 28: compulsory school insurance
All students who are under 28 years of age at the time of enrolment must pay the compulsory insurance (Seguro Escolar), which is managed by the INSS (National Social Security Institute).
If immediate action as described in section 2 of this protocol is not required, in the event of an accident the student shall:
- Report the accident immediately to the clinical tutor and the associate lecturer.
- The injured party can go to all public health centres or to any of the collaborating medical centres. In the event of going to a non-contracted health centre, he/she may be treated in any private centre and pay the expenses incurred, in order to request their reimbursement at a later date. The insurance medical inspector will assess the urgency and seriousness of the accident in order to pay the totality of the expenses or to apply the current insurance rates.
- Complete and submit the application for the school insurance benefit to the Social Security. Please note that some of the information must be completed by the school.
- Complete and send to OSSMA (ossma@ub.edu) the accident notification form, in case the accident needs to be assessed and any measures to improve the management of the internships need to be taken.
Further information on the benefits of the school insurance can be found at: https://www.ub.edu/sae/serveis/assegurances/
2.2.2. Over 28 years old: accident insurance
From the age of 28, students are not covered by compulsory school insurance.
These students must take out voluntary accident insurance to cover them for any accidents they may have, both on university campuses and in companies or institutions, in the event of work placements, as long as there is no employment relationship.
For the academic year 2024-25, the University of Barcelona offers the possibility of taking out a voluntary policy with the company Allianz (broker Ferrer&Ojeda).
If immediate action as described in section 3 of this protocol is not required, in the event of an accident, the student who has paid the voluntary insurance shall:
- Report the accident immediately to the clinical tutor and the associate lecturer.
- Contact the insurance company to find out which medical centre you can go to according to the protocol of the mutual insurance company: allianz-com-actuar-en-cas-accident-cat.pdf (ub.edu)
- Fill in the accident declaration from the insurance company.
- Complete and send to OSSMA (ossma@ub.edu) the accident notification form, in case the accident needs to be assessed and any measures to improve the management of the internships need to be taken.
For more information on voluntary insurance see: https://www.ub.edu/sae/serveis/assegurances/voluntaria.html
3. Trainees in health care institutions in case of accidental puncture, cut or splash with medical or biohazardous material, or biohazardous situations.
In the event that the student suffers an accident during the work placement and requires rapid medical attention due to accidental puncture, cut or splash with sanitary material or biological risk, or situations of biological risk (this section considers the first care due to accidental puncture, cut or splash with sanitary material or biological risk, or situations of risk the student finds, there will be a first intervention in the health institution where the student is doing the work placement and can go to the following places depending on the centre where the student is doing the work placement:
- Students doing their work experience at the Bellvitge University Hospital (HUB); at the Primary Care and Community Management Departments in Baix Llobregat, Delta and Penedès; at intermediate care centres and at other centres in the South Metropolitan Health Region, will go to:
- Preventive Medicine Service of the Hospital Universitari de Bellvitge.
- Address: Outpatients Building (module B3). Ground floor. Carrer de la Feixa Llarga, s/n. L’Hospitalet de Llobregat. Tel. 93 260 75 57 ext. 8587. Timetable from 8 am to 1.30 pm.
- In the event of an accident occurring during the evening or night shift, or requiring immediate attention, go to the emergency department.
- Students doing their placements at the Hospital Clínic de Barcelona (HCB); in Primary Care and in the Community, intermediate care centres and other health centres in other Health Departments and Regions not indicated in the previous section; and in centres where the necessary care is not provided, will go to:
- Day hospital for infectious diseases at Hospital Clínic.
- Address: Calle Villarroel, 170. Esc. 2 pta 1. Opening hours: from 8h to 17h.
- Emergency Department Infectious Diseases Department on call. Opening hours: from 17h to 8h
- Students on placements in hospital centres (non-HUB and HCB) will go to:
- The centre’s emergency service.
- If the centre does not have an emergency service, you can go to the emergency department of the Hospital Universitario de Bellvitge or the Hospital Clínic de Barcelona, or to the one you are referred to.
Once this first intervention has been carried out at the health institution where the student is on placement at the time of the accident, the student shall follow the procedures set out in the points defined in sections 2.1 and 2.2, depending on the student’s situation.
Once this first intervention has been carried out, the student must request all the medical documentation related to it for the correct follow-up of the accident as regulated in sections 2.1 and 2.2.
The student must also request information from the source in order to report it to the Mutua Universal, to their public health care reference centre, or to other centres with an agreement with the school or accident insurance, according to their situation. This data must be provided by means of a template designed for this purpose, signed by a health official (to ensure that what is written on the template is a real transcription of the analysis carried out), or the health centre may provide the student with the analysis of the source, on paper and anonymised, without any data that would allow it to be recognised.
On the other hand, in the event that the student needs to follow up the accident, this will be done from:
- Mutua Universal: in the case of trainees who are registered by the UB with the Social Security in accordance with the 52nd additional provision of the TRLGSS.
- Public Health Service or centres with an agreement with the compulsory school insurance scheme: in the case of students under 28 years of age on work experience who are not registered by the UB with the Social Security system due to incompatibility in accordance with article 80 of Royal Decree 8/2023.
- Centres with an accident insurance agreement: for students over 28 years of age on work placements who are not registered with the UB’s social security system due to incompatibility in accordance with article 80 of Royal Decree 8/2023, and who have taken out compulsory accident insurance.
THE STUDENT MUST INFORM THE CENTRE WHERE HE/SHE IS ATTENDED OF HIS/ HER STATUS AS A STUDENT REGISTERED AT THE FACULTY INDICATING HIS/ HER STATUS (REGISTERED WITH SOCIAL SECURITY, OBLIGATORY SCHOOL INSURANCE or INSURANCE) tests carried out (analyses, treatments, patient analyses…).
IN THE EVENT THAT THE STUDENT RECEIVES AN INVOICE FOR THE CARE RECEIVED FROM THE CENTRE WHERE HE/SHE HAS BEEN ATTENDED, HE/SHE SHOULD CONTACT THE SECRETARY’S OFFICE FOR STUDENTS AND TEACHING AT THE CAMPUS WHERE HE/SHE IS ENROLLED.
